VASTUKUNDLI CLIENT AGREEMENT & CONSULTATION WAIVER
PLEASE READ THIS AGREEMENT CAREFULLY BEFORE PROCEEDING WITH ANY BOOKING, PAYMENT, CONSULTATION, COMMUNICATION, OR INTERACTION WITH VASTUKUNDLI, AND BY CHECKING THE BOX, CLICKING SUBMIT, MAKING PAYMENT, OR OTHERWISE INDICATING ACCEPTANCE THROUGH ANY DIGITAL MEANS, YOU EXPRESSLY AGREE TO BE LEGALLY BOUND BY THE TERMS AND CONDITIONS CONTAINED HEREIN, WHICH CONSTITUTE A FULL, EXHAUSTIVE, AND LEGALLY ENFORCEABLE CONTRACT BETWEEN YOU, THE CLIENT, AND GAURAV JINDAL, OPERATING UNDER THE NAME VASTUKUNDLI, INCLUDING ANY EMPLOYEES, CONTRACTORS, AFFILIATES, CONSULTANTS, PLATFORMS, OR REPRESENTATIVES, HEREINAFTER COLLECTIVELY REFERRED TO AS VASTUKUNDLI.
1. AGREEMENT TO HIRE SERVICES
The client voluntarily, knowingly, and irrevocably agrees to engage the services of Gaurav Jindal, operating as VastuKundli, for the purpose of receiving astrological, vastu-related, or spiritually oriented advisory consultations relating to residential, commercial, industrial, or other properties, as well as personal, situational, or general life-related matters, all as may be disclosed or provided by the client during the booking process, any associated communications, or during the consultation itself, including but not limited to verbal discussions, written messages, digital forms, uploaded media, floor plans, photographs, property layouts, dates, times, locations, or other situational data, hereinafter collectively referred to as “Client Data,” which the client provides solely at their own discretion, for the limited purpose of facilitating interpretive guidance and advisory discussions.
The client acknowledges that engagement with VastuKundli does not create, and cannot be construed to create, any contractual, fiduciary, professional, medical, legal, financial, architectural, engineering, real estate, or other licensure-based professional relationship and that the scope of engagement is strictly limited to the advisory discussion and interpretive guidance based on traditional belief systems, experiential knowledge, or cultural practices, which are inherently subjective.
2. ADVISORY NATURE OF CONSULTATION AND RECOMMENDATIONS
The client fully acknowledges and agrees that any and all statements, observations, interpretations, opinions, suggestions, recommendations, or guidance, whether communicated orally, in writing, digitally, visually, or by any other method, constitute advisory input only, are inherently non-binding, non-prescriptive, and non-determinative, and may not reflect outcomes, probabilities, or empirically verifiable results. The client agrees that the use, non-use, implementation, or partial implementation of any such guidance is undertaken entirely at the client’s own discretion, volition, and risk.
The client expressly understands that VastuKundli does not guarantee, warrant, or otherwise imply any specific results, benefits, improvements, or consequences, whether of a financial, personal, relational, health-related, psychological, emotional, spiritual, property-related, or other nature, whether presently known or unknown, direct or indirect, immediate or long-term. The client further acknowledges that reliance upon any guidance does not constitute professional advice of any legally recognized kind and that consultation outcomes are contingent upon numerous variables beyond the control of VastuKundli.
3. LIMITATION OF LIABILITY, WAIVER, AND RELEASE
To the maximum extent permitted by applicable law, the client, on behalf of themselves and all heirs, executors, administrators, successors, assigns, beneficiaries, or any other related parties, expressly, irrevocably, and unconditionally releases, waives, discharges, and covenants not to sue Gaurav Jindal, VastuKundli, its employees, contractors, associates, volunteers, third-party consultants, or any other representatives from any and all claims, demands, actions, causes of action, liabilities, losses, costs, expenses, or damages of any kind or nature, whether known or unknown, suspected or unsuspected, foreseen or unforeseen, arising out of or relating directly or indirectly to the consultation, guidance, recommendations, advice, or any ancillary service provided, including but not limited to claims arising from financial decisions, emotional responses, relational dynamics, professional outcomes, property decisions, or other consequences of any type.
The client expressly acknowledges that this waiver encompasses, without limitation, claims of negligence, misrepresentation, breach of warranty, reliance, omission, or any other legal or equitable theory to the fullest extent permitted by law, including claims under California Civil Code Section 1542 and other analogous international provisions. The client expressly waives all rights under Section 1542, which states: “A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor.”
4. PAYMENT, REFUND, AND SCHEDULING POLICIES
The client acknowledges and agrees that all fees associated with consultations, reports, analysis, or related services, whether purchased through online booking, Stripe, PayPal, or any other payment platform, are final, non-refundable, and non-transferable for any reason whatsoever. The client acknowledges that upon successful payment confirmation, the booking is irrevocable, appointments cannot be rescheduled, postponed, or modified, and missed appointments will be treated as fully rendered services.
Clients booking from jurisdictions outside the United States, including Canada, acknowledge that currency conversion, cross-border payments, and international banking regulations are their responsibility and agree that VastuKundli is not liable for delays, fees, or errors arising from payment processing.
5. CLIENT RESPONSIBILITY AND ACCURACY OF INFORMATION
The client affirms that all Client Data provided is accurate, truthful, complete, and voluntarily supplied and agrees that they bear sole responsibility for any consequences, actions, decisions, or outcomes arising from consultation, including those related to property, finances, relationships, health, personal well-being, or professional matters. The client further acknowledges that the client’s active engagement, discretion, and personal judgment are essential to the consultation process, and any reliance upon recommendations occurs at the client’s own risk.
6. GOVERNING LAW, JURISDICTION, AND DISPUTE RESOLUTION
This agreement and all matters related thereto shall be governed, construed, and enforced in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. The client consents to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California, for any disputes arising out of or related to this agreement, including disputes concerning interpretation, enforcement, or alleged breach.
Before initiating any legal proceedings, the parties expressly agree to attempt to resolve all disputes through informal negotiation in good faith. If unresolved, all disputes shall be submitted to binding arbitration in Los Angeles County, California, in accordance with the American Arbitration Association (AAA) rules. The arbitration award shall be final, binding, and enforceable in any court of competent jurisdiction. Clients accessing services from outside California or the United States expressly consent to the application of California law and Los Angeles County jurisdiction, waiving any local, regional, or national claims to conflicting laws.
7. DIGITAL ACCEPTANCE AND ELECTRONIC SIGNATURE
By electronically checking the acceptance box, submitting this form, clicking the confirmation button, or otherwise indicating assent digitally, the client confirms that they have read, understood, and agreed to all terms and conditions herein. The client acknowledges that such electronic acceptance constitutes a legally binding electronic signature enforceable under the United States ESIGN Act, the California Uniform Electronic Transactions Act (UETA), and any analogous international electronic signature laws applicable to the client’s jurisdiction. The client further acknowledges that electronic acceptance is equivalent in all respects to a handwritten signature executed in physical form.
8. INTEGRATION WITH ONLINE BOOKING AND COMMUNICATION WORKFLOWS
The client acknowledges that bookings may be facilitated through online platforms including Stripe or other third-party payment processors, and that confirmation, scheduling, and follow-up communications may be sent through email, SMS, or messaging applications such as WhatsApp. The client consents to receiving such communications and acknowledges that all notifications, reminders, and auto-filled messages constitute official communication for the purposes of this agreement. The client agrees to provide accurate contact information for the delivery of confirmations and communications and understands that failure to provide correct information may impact the timeliness or effectiveness of the consultation.
9. INTERNATIONAL CLIENTS AND CROSS-BORDER ACKNOWLEDGMENT
Clients accessing services from countries other than the United States acknowledge and agree that they do so voluntarily and that they accept all terms, conditions, governing law, and jurisdiction provisions contained herein. The client agrees that any dispute or claim arising from the consultation or this agreement shall be subject to California law and the exclusive jurisdiction of Los Angeles County courts or binding arbitration in California, and that any conflicting local laws are expressly waived to the extent legally permissible.
10. ENTIRE AGREEMENT
This agreement constitutes the full and complete understanding between the client and VastuKundli and supersedes any prior communications, representations, understandings, or agreements, whether oral or written, relating to the subject matter herein. Any modification, amendment, or waiver of any term or condition must be in writing, signed electronically or physically by VastuKundli. If any provision of this agreement is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect to the maximum extent permitted by law.
